Terms and Conditions

By using or accessing any mobile application for such websites or any other website operated by us on which these Terms and Conditions are posted via a link or otherwise (each referred to herein as the “Site”), you acknowledge and agree to be bound and to be subject to the following terms and conditions, as well as our Privacy Policy, which also governs your use of the Site, and is incorporated by reference (These Terms and Conditions with the Privacy Policy shall be referred to as the “Terms“). Please read these Terms carefully, as they contain important information about limitations of liability and resolution of disputes through arbitration rather than court.

Our mission is to make the trip of our users an incredible experience, without setbacks, without extra costs and with everything at hand; we know that our users are different, unique and we are aware they belong to a very special place: a beautiful family!

Purpose and Scope

Scope

We urge all users to be responsible about their use of this Site and any transaction entered into as a result of either listing or renting a property. We do not own or manage, nor can we contract for, any vacation rental listing listed on a Site. The Site provides an on-line marketplace to allow homeowners and listing managers who advertise on the Site (hereinafter known as “Hosts”) to offer for rent in a variety of pricing formats, a specific vacation or short-term rental listing to potential renters or renters (each, a “Traveler” and, collectively with a host, the “Users”).

TravelBaby Responsibilities

TravelBaby is merely the operator of the Site and does not offer accommodations on the Site itself. The rental agreement (“Host Services”) is concluded exclusively between the Host and the Traveler under the conditions agreed upon between them and that are included in the Listing and confirmed in the Booking. TravelBaby does not become a party to the Host Services, does not act as a representative of one of the parties to such agreement and does not act as a broker. TravelBaby does not influence the decision on the conclusion of rental contracts between the Users, but merely provides the technical infrastructure for the initiation and conclusion of the contracts. Consequently, each user bears sole responsibility for any aspect of an actual or potential transaction between a traveler and a host. This includes but is not limited to the quality, condition, safety, or legality of advertised properties, the accuracy of listings (including their content and any reviews about travelers or properties), and the ability of users to rent vacation properties or enter into contracts for them. You understand and accept that you might need to agree to separate agreements, waivers, or terms and conditions before completing a booking or purchasing a product or service. Additionally, TravelBaby reserves the right to impose further restrictions on your booking, product, or service.

Site Purpose

The Site only serves to conclude Host Services for residential listing for temporary use. The Host and the Traveler insure in this respect that the Traveler, according to their common understanding, does not intend to move his permanent center of life to the apartment, but only a temporary use is intended.

Governing Use and Access of the Site

These Terms regulate conclusively the terms and conditions under which users can use and access the Site and TravelBaby provides the related services. Deviating terms and conditions of the Users do not apply, even if they are not expressly contradicted or TravelBaby provides the services without reservation in knowledge of these terms and conditions.

Under these Terms, “use“ or “access“ of the Site specifically includes any direct or indirect access or use of the Site or any cached version of the Site and any direct or indirect access or use of any information or content on the Site, regardless of how obtained and the term “Site“ includes, without limitation, any cached version thereof.

Unless otherwise specified, the entity controlling the Site you are accessing is referred to herein as “TravelBaby,” “we,” “us” or “our”. The term “you“ refers to the user visiting the Site, listing a Listing, and/or requesting a reservation on this Site, or our customer service agents.

Read this Terms Carefully

You should read through all the Terms carefully. The Terms constitute a legally binding agreement between you and TravelBaby. You are not authorized to use this Site unless you are at least 18 years of age and able to enter into legally binding contracts. We do not knowingly collect the information of anyone under the age of 18. If you arrived on the Site after having been re-directed or otherwise clicking on another website, you agree that these Terms shall govern your use of this Site.

Compliance with Laws

General Compliance with Applicable Laws

Users agree that they are responsible for, and agree to abide by, all laws, rules and regulations of the Republic of Colombia and any other laws applicable to their use of the Site, their use of any tool, service or product offered on the Site and any transaction they enter into on the Site or in connection with their use of the Site.

Hosts Representation regarding Compliance with Laws

Hosts further agree that they are responsible for and agree to abide by all laws, rules, and/or regulations applicable to the listing of their rental listing and the conduct of their rental business, including but not limited to any and all laws, rules, regulations or other requirements relating to but not limited to taxes, credit cards, data and privacy, permits or license requirements, zoning ordinances, safety compliance and compliance with all anti-discrimination, as applicable. Please be aware that, even though we are not a party to any rental transaction and assume no liability for legal or regulatory compliance pertaining to rental properties listed on the Site, there may be circumstances where we are nevertheless legally obligated (as we may determine in our sole discretion) to provide information relating to your listing in order to comply with requests from governmental bodies in relation to investigations, litigation or administrative proceedings, and we may choose to comply with such obligations in our sole discretion.

Services by TravelBaby

Digital Communication Environment

TravelBaby provides a digital communication environment for the conclusion of contracts between Hosts and Travelers via the Site, on which Hosts can post information about their apartments as well as photos and the conditions of the rental. Travelers have the opportunity to search for propertys that meet their needs, compare prices and other conditions, contact Hosts and conclude a Host Services.

Accessibility of the Site

TravelBaby will use commercially reasonable efforts to ensure the accessibility of the Site. Due to maintenance work carried out on the Site, the further development of functionalities or malfunctions, the possibilities of use may be restricted or temporarily interrupted. TravelBaby will announce such restrictions or interruptions to the users in a timely manner, as far as possible.

Fraudulent or other Illegal Activities

While we do take certain measures with a goal to assist users to avoid potentially fraudulent or other illegal activity of which we become aware, we assume no liability or obligation to take any such measures or actions. When we provide warnings or messages to users about any such activity, we do not warrant that such messages are accurate or that such messages will reach any or all users they should have reached in a timely manner or at all or that such messages or measures will prevent any harm or otherwise have any impact.

Use of the Site

Registration

Some functions of the Site, in particular the posting of listings by Hosts and the submission of booking requests by Travelers, require prior registration. The creation of an account is only permitted to legal entities, partnerships, and natural persons of at least 18 years of age. When registering, accurate and complete information must be provided. This information must also be kept up to date at all times thereafter.

The login data may only be used by the respective authorized user. The account may not be transferred to third parties. The user is obligated to keep the login data secret and to protect it from unauthorized access by third parties. If there is a possibility that third parties could have unauthorized access to the account, TravelBaby must be informed immediately. In this case, TravelBaby reserves the right to take measures against this and in particular to block the account or to change the login data. The user is responsible for all activities that are carried out using his user account unless he cannot be held accountable for the misuse of his user account due to no violation of the duties of care that rest upon him.

When you provide your e-mail address, name or other information to us in connection with your use or access to the Site, any service or tool provided on the Site or otherwise, you agree to allow the Site to add your e-mail address, name or other information provided to our database of users. You may receive one or more promotional e-mails from the Site. You are welcome to opt not to receive such promotional e-mails from the Site at any time. Please review our Privacy Policy for more information regarding our email and other data collection practices and safeguards. Your use of the Site signifies your acknowledgment of, and agreement with, our Privacy Policy. We adhere to strong principles of privacy. You agree that we may access and use your user-contributed content in accordance with these Terms or our Privacy Policy and we agree that we will only disclose your user-contributed content in accordance with these Terms and our Privacy Policy.

Limited License to use the Site

Users are granted a limited, revocable non-exclusive license to access the Site and the content and services provided on the Site solely for the purpose of advertising a listing, searching for a listing, purchasing or researching (for the purpose of inquiring about purchasing) any of the products or services offered on any Site, participating in an interactive area hosted on the Site or for any other purpose clearly stated on a Site, all in accordance with the Terms. Any use of the Site that is not for one of these purposes or otherwise in accordance with the Terms or as otherwise authorized by us in writing is expressly prohibited.

Unauthorized Uses of the Site

The license to use the Site only extends to the uses expressly described herein. The license to use the Site granted to users in these Terms does not include any right of collection, aggregation, copying, scraping, duplication, display or any derivative use of the Site nor any right of use of data mining, robots, spiders or similar data gathering and extraction tools without our prior written permission; provided, however, that a limited exception from the foregoing exclusion is provided to general purpose internet search engines that use tools to gather information for the sole purpose of displaying hyperlinks to the Site, provided they each do so from a stable IP address or range of IP addresses using an easily identifiable agent and comply with our robots.txt file. “General purpose internet search engines” do not include a website or search engine or other service that provides classified listings or listing rental advertisements, or any subset of the same or which is in the business of providing vacation listing rental services or other services that compete with us.

Unauthorized uses of the Site include, but are not limited to, the following activities. You agree not to engage in any of the actions listed below unless you have received prior and explicit permission from us:

Any commercial use of the Site or its content, except by members in good standing or by members holding a valid license to software offered on the Site.

Using the Site or its tools and services to book or solicit rentals for properties not listed under a valid subscription or pay-per-booking product.

Copying, reproducing, uploading, posting, displaying, republishing, distributing, or transmitting any part of the content in any form.

Reproducing any portion of the Site on your website or elsewhere using any device, including framing or border environments around the Site or other techniques to enclose or replicate any part of the Site.

Deep-linking to any portion of the Site without our express written permission.

Modifying, translating into any language or computer language, or creating derivative works from any content or part of the Site.

Reverse engineering any part of the Site.

Selling, offering for sale, transferring, or licensing any part of the Site in any form to third parties.

Using the Site and its inquiry or booking functionality for purposes other than advertising and/or researching vacation rentals, making legitimate inquiries to our members, or any other use expressly authorized on the Site.

Posting or transmitting false, fraudulent, or misleading information, including making reservations or inquiries under false pretenses, or engaging in phishing or any activity that could result in criminal or civil liability.

Posting or transmitting any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, indecent, inflammatory, sexually explicit, pornographic, or profane material.

Violating, plagiarizing, or infringing upon our rights or the rights of third parties, including, but not limited to, copyright, trademark, patent, trade secrets, rights of publicity or privacy, or any other intellectual or proprietary rights.

Using or accessing the Site in any manner that, at our sole discretion, adversely affects or could adversely affect the performance or function of the Site or any other system used by us or the Site.

If you notice or encounter any content, activity, or communication on the Site that seems to breach the above restrictions or any other terms outlined here, please notify us by reaching out through the “Contact Us” section below.

Verification

Verifying users online is challenging, and we do not take responsibility for confirming each user’s claimed identity. We recommend using the communication tools provided on the Site to interact directly with travelers or hosts. However, even this method does not guarantee the identity of the person you are communicating with. We also advise taking reasonable steps independently to verify the identity of the other person and, for travelers, to verify the details of the listing and your booking or intended booking.

You further agree to (i) Safeguard and maintain the security and confidentiality of your password and online ID for both your account with us and your email account. Share this information only with authorized users of your accounts, (ii) Instruct anyone you authorize to use your online ID and password not to disclose them to unauthorized individuals, (iii) Promptly inform us and update your online ID and password if you suspect that your password for either your account with us or your email account may have been compromised, (iv) Immediately notify us if you receive any communication requesting your online ID and password. Furthermore, if we suspect unauthorized access to your account, you agree to promptly change your online ID and password at our request and take any other reasonable actions we may request to secure your account.

Each user acknowledges and agrees that: (i) TravelBaby bears no responsibility for any unauthorized transactions made using a user’s ID or password; and (ii) Unauthorized use of your online ID and password for your TravelBaby account or email account could result in liability to both TravelBaby and other users.

Additionally, we reserve the right to suspend or cancel your listing at any time, without prior notice to you, if we suspect, at our sole discretion, that your account with us or your email account is being used in an unauthorized or fraudulent manner, even without receiving notification from you.

Use of other Users Information

You agree that any personal information of other users obtained directly or indirectly from or through the Site or any related communication, transaction, or software is licensed to you solely for the following purposes: (i) Site-related communications that are not unsolicited commercial messages, (ii) using services offered through the Site, and (iii) facilitating financial transactions related to the Site’s purpose (such as inquiring about or booking a listing or processing a personal credit card charge). Any other use requires explicit permission from the user. You may not use such information unlawfully or with malicious intent.

You must provide users with the opportunity to remove their information from your address book, database, or other records, and to review the information collected about them. Except as provided in this Terms, you may not disclose another user’s personal information to any third party without their consent. You acknowledge that other users may use your personal information to communicate with you in accordance with these Terms and with the Booking.

Furthermore, you agree to protect other users’ personal information with the same level of care as your own confidential information (using at least a reasonable standard of care), and you accept all liability for any misuse, loss, or unauthorized transfer of such information.

We strictly prohibit spam or unsolicited commercial electronic communications of any kind. Therefore, you are not permitted, without limitation, to add a Site user, even if they have rented a short-term listing from or to you, to your mailing list (email or physical mail) without their explicit consent. You may not use any tool or service on the Site to send spam or unsolicited commercial electronic communications, or in any other manner that violates these Terms.

Reasonability for Content

We do not have an obligation to pre-screen content that users, travelers, or other individuals post on the Site, whether it is directly contributed by the user or contributed by us or a third party on behalf of the user. This includes listings, reviews of rental properties or travelers, participation in interactive communities, forums, blogs, or any other content provided by a user to the Site (collectively referred to as “user-contributed content”). We are not liable for user-contributed content. “User-contributed content” also encompasses information provided by a user or any other individual to a third-party website or mobile application, which is subsequently shared with our Site via a tool we offer or any other authorized exchange of user-contributed content.

We maintain the right to refuse or remove from the Site, at our sole discretion, any user-contributed content that does not met internal policies, or if it otherwise violates these Terms. User-contributed content may also be removed if we are notified, for example, by a user or third party, that such content appears to breach any part of these Terms or other requirements governing its posting, as determined at our discretion. Additionally, we reserve the right, without obligation, to make non-substantive edits to a member’s or user’s content to ensure compliance with these Terms or formatting requirements. Users are responsible for reviewing their user-contributed content to ensure its accuracy and absence of misleading information.

User-contributed content must, at a minimum (as determined at our discretion):

Not infringe on anyone’s rights, including but not limited to copyright, publicity, and privacy rights, or violate the law or be otherwise inappropriate;

Not include personal information of another person that can be used to identify or contact them;

Not contain unsolicited promotional content, advertising, political campaigns, contests, raffles, or solicitations;

Be directly related to the Site, business service, product, or forum where the content is submitted;

Not be obscene, abusive, discriminatory, or illegal;

Not be false or misleading.

Translations and Maps

If any user-contributed content created by users is translated for display on the Site, we cannot guarantee the accuracy or quality of such translation and the user is solely responsible for the review, verification and accuracy of such translation. Maps provided on the Site that are provided by Google are subject to the Google Maps terms and conditions located at: .

Terms Applicable to Hosts

Creation of Listings

Hosts listing an apartment for rent on the Site expressly confirm their authority to offer and rent out the listing. Hosts are fully liable to TravelBaby ant its contractual partners, if any, for any and all losses and damages that may result from a lack of authorization to offer or rent out the listing. Additionally, Hosts affirm their awareness of their agreements with third-parties or any local law or regulation governing leasing practices in Colombia and the city where the listing is located and agree not to engage in any unlawful subletting practices.

Hosts must accurately and thoroughly describe the property they list on the Site. This includes providing at least the required information when creating the listing. Photos must accurately depict the current condition of the listing and should be updated promptly whenever changes are made. Availability information must also be consistently kept up to date.

If Hosts offer multiple properties on the Site, the information and documents must be provided separately for each listing. Furthermore, each listing may only have one listing on the Site. Creating multiple listings for the same listing is prohibited. However, this does not restrict creating separate listings for individual parts of a single apartment that are offered for rent separately.

Hosts may be required by Travelbaby to provide further documents and information in their listing.

Hosts are not allowed to post listings on the Site that contravene legal regulations, official orders, or societal norms. Additionally, they are prohibited from publishing content that infringes upon the rights of third parties, including but not limited to copyrights, trademark rights, or personal rights.

Hosts assure that the all-inclusive rental price determined by them includes all incidental expenses that occur. This includes, without limitation, operational expenses, utilities and, internet.

It is the sole responsibility of the Host to include all applicable restrictions, amenities, check-in, check-out and cancellation policies in the listing, as this would be the binding terms for the Host Services between the Host and the Traveler once a Reservation is confirmed.

All listing on the Site are the sole responsibility of the Host (whether the owner, a listing manager, or an authorized agent of the owner). We expressly disclaim any liability for the alleged accuracy of the listings, reviews, or any alleged breaches of contract by Users. Hosts are solely responsible for ensuring their listing information on the Site is current, including but not limited to representations about the listing, its amenities, location, price, and availability for specific dates. We do not guarantee that any content, including Traveler or listing reviews, guest book entries, listing locations, suitability, pricing, or availability information on the Site, is accurate or up-to-date, even when Travelers search for specific dates or listing types.

Granting of rights and warranty

The Host grants TravelBaby a royalty-free, non-exclusive rights, unlimited in duration and geographic scope, to the content provided for the creation of the listing, including but not limited to descriptive texts and photos. These rights include the ability to use this content in whole or in part, transfer these rights, and grant sublicenses as necessary for TravelBaby to provide its contractual services to Users. This includes the right to publish, reproduce, distribute, and make the content publicly available by any means and in any form. It also encompasses the right to edit the content and use it in its edited form. Such use includes displaying listings on the Site, especially when utilizing the search function, as well as on third-party websites for the purpose of advertising the listing.

The Host guarantees that the uploaded content is free from third-party rights, that he has the unrestricted authority to use these rights without any third-party claims, and that he has not and will not otherwise transfer these rights. Furthermore, the Host guarantees that he has obtained all necessary consents and authorization from any identifiable persons featured in the content and that the content does not infringe upon any other third-party rights.

Appearance in Search Results

We cannot guarantee that your listing will appear in any specific order in search results on the Site. Search order will fluctuate based on a variety of factors such as search parameters, subscription level purchased, listing quality, how frequently a calendar is updated, traveler preferences, user response time, reservation history, online booking capability, compliance with posted listing practice requirements, and other factors that we may deem important to the user experience from time to time (“Best Match”).

Listing appearance or order in any particular search result may also vary depending on the search criteria used by the particular traveler. We reserve the right to apply various search algorithms or to use methods to optimize Best Match results for particular travelers’ experiences and the overall marketplace. Listings may not always appear in search results. Listings distributed on third-party sites are not guaranteed to display on such third-party site in any particular order or at all. Search results and order may appear different on TravelBaby’s mobile application than they appear on the Site. To optimize the search experience for both members and travelers and improve the Best Match process, TravelBaby retains the right to run occasional tests that will be limited in duration but may alter how we display listings and search results.

Hosts Payment Method Requirements

No Host may request any traveler to mail cash or utilize any instant-cash wire transfer service in payment for all or part of a Host Services transaction. Any violation of this term or any other unacceptable payment methods that may be posted on the Site may result in the immediate removal of the non-conforming listing from the Site without notice to the host and without refund. From time to time, we may become aware of users attempting to conduct a transaction that would involve an unauthorized payment method or a fraudulent payment method. Ideally, we hope to be able to assist users in avoiding such transactions, but we assume no liability or responsibility to do so or to inform users of any such actual or suspected activity.

Host Responsibilities and Assumption of Risk

You are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you allow to participate in providing your Host Services. You are responsible for setting your price and establishing rules and requirements for your listing. You must describe any and all fees and charges in your listing description and may not collect any additional fees or charges outside the Site. Do not encourage Travelers to create third-party accounts, submit reviews, provide their contact information, or take other actions outside the Site.

If you collaborate with a co-host or work with a team, business, or organization, you assume responsibility and liability as a Host under these Terms for the actions and omissions of each entity and individual involved in providing your Host Services. You are also responsible for informing any personnel engaged by you to deliver Host Services about their obligations under these Terms. When you accept terms or enter contracts with third parties, you affirm that you have the authority to enter into contracts on behalf of your team, business, or organization, and that each entity you utilize is legally compliant in its jurisdiction. If you undertake additional roles, you confirm that you have the authority to perform those roles. If you instruct TravelBaby to distribute a portion of your payout to a co-host or other Hosts, or to make payments to another individual, you must have authorization to do so, and you bear responsibility and liability for the accuracy of the payout information provided and the amounts paid.

You acknowledge that hosting carries inherent risks and agree that you assume the entire risk arising out of your access to and use of the Site, offering Host Services, or any interaction you have with other Users whether in person or online. You agree that you have had the opportunity to investigate the Site and any laws, rules, regulations, or obligations that may be applicable to your listing or Host Services and that you are not relying upon any statement of law made by TravelBaby.

Hosts are solely responsible for obtaining insurance coverage sufficient to protect their properties and guests or their trip, as applicable. Hosts agree that they have or will obtain the appropriate insurance coverage sufficient to cover the rental of the properties they list on the Site before the arrival of their first traveler and will maintain adequate insurance coverage through the departure date of any traveler they have obtained via our Site. Further, users agree to provide us with copies of relevant proof of coverage upon request.

As a Host, you are responsible for determining and fulfilling your obligations under applicable laws to report, collect, remit, or include in your price any applicable VAT or other indirect taxes, occupancy taxes, tourist, income, or other taxes (“Taxes”).

Additional Host Representations

Each Host represents and warrants that: (i) it owns and/or has all necessary rights and authority to offer for rent and to rent the listing listed by such host; (ii) it will not wrongfully withhold a rental deposit in breach of the underlying Host Services Agreement; (iii) it will accurately describe the subject rental listing, will not fail to disclose a material defect in, or material information about, a rental listing and will upon request, or otherwise from time to time, review the listing listing content and location or geographic description to ensure it is accurate and not misleading ; (iv) it will not wrongfully deny access to the listed listing; and (v) it will not fail to provide a refund when due in accordance with the applicable cancellation policy or underlying rental agreement. In addition, if TravelBaby, through one of its guarantee or warranty programs and in its sole discretion, compensates a traveler for a loss caused by acts or omissions attributable to a member, TravelBaby reserves the right to pursue the member for the amount paid or contributed towards the loss.

Upon our request, each host agrees to promptly provide to us such proof of personal identification, proof that the condition, location, or amenities associated with the listing are accurately described in the listing, proof of ownership of the listing listed on the Site, and/or proof of authority to list the listing. If you are a traveler who is listing a home, condominium, or apartment, please refer to your rental contract or lease, or contact your landlord, prior to listing the listing to determine whether your lease or contract contains restrictions that would limit your ability to list your room, home, condominium or apartment. Listing your home may be a violation of your lease or contract and could result in legal action against you by your landlord, including possible eviction.

Terms Applicable to Travelers

Booking

Upon receiving a booking request from a Traveler through the Site, TravelBaby will notify the Host. The Host must accept the request without undue delay or reject it with justification.

Following the acceptance by the Host, TravelBaby will contact the Traveler to confirm the booking. In case of acceptance, the Traveler will be asked to pay the service fee and subsequently the listing will be reserved for the Traveler on TravelBaby (“Accomodation Reservation” or “Reservation”)

When a Traveler books a listing, they agree to pay all charges associated with the booking. This includes the listing price, applicable fees (including the Travelbaby service fee), offline fees, taxes, and any other items identified during checkout (collectively, the “Total Price”).

If you choose to pay in a currency different from the one set by the Host for their listing, the displayed price is based on a currency conversion rate determined by us. Additionally, you agree that TravelBaby may charge the payment method used to book the listing to collect Damage Claim amounts.

When a Host receives the booking confirmation, a contract for Host Services or Reservation is established directly between Traveler and the Host. By making a Reservation, Traveler agrees to the terms of this contract. These terms encompass these Terms of Service, all terms specified in the Reservation, including but not limited to the cancellation policy, and any other rules, standards, policies, or requirements stated in the Listing or during checkout that apply to the Reservation. It is your responsibility to carefully review and comprehend these contractual terms, including these Terms of Service and all Reservation terms, including rules, standards, policies, and requirements, before booking a listing. Please note that some Hosts collaborate with co-hosts or operate as part of a team to provide their Host Services.

Service Fee

We charge a service fee to travelers who book a listing on the Site via the Site’s checkout process. This fee covers the use of the Site, including features like 24/7 user support, and is calculated as a variable percentage of the total reservation amount (which may include additional fees, taxes, and damage deposits). VAT may be added to the service fee, depending on the traveler’s or member’s jurisdiction. The exact service fee and any applicable VAT will be displayed to travelers at the time of booking. The service fee and applicable VAT will be charged after both the traveler and the host accept the reservation. The service fee is refundable only if the traveler is entitled to a refund of the entire rental amount under the listing’s cancellation policy. Any taxes claimed by any taxing authority on the service fee are TravelBaby responsibility, and hosts are not liable for such taxes. Hosts agree not to encourage or advise travelers to avoid or circumvent the service fee charged by TravelBaby.

The amount of the service fee charged from the Host is displayed during the booking process before the booking is completed.

The service fee is non-refundable. Travelbaby may, at its own discretion and considering the circumstances that led to the cancellation of a booking, reduce the amount or refrain from asserting the claim.

Traveler Responsibilities and Assumption of Risk

You are accountable and responsible for your own actions and omissions, as well as for the actions and omissions of anyone you invite to access any accommodation, common areas. This includes responsibilities such as: (i) ensuring the accommodation and related personal listing, as well as common areas, are left in their original condition, (ii) settling any reasonable Damage Claim amounts, and (iii) conducting yourself with integrity, showing respect to others, and adhering to applicable laws at all times. If you book for a minor guest or bring a minor to a Host Service, you must have legal authority to act on behalf of the minor and assume full responsibility for their supervision.

You acknowledge that many activities carry inherent risks and agree that, to the maximum extent permitted by applicable law, you assume the entire risk arising out of your access to and use of the Site and any content, including your stay at any listing, or any other interaction you have with other Users whether in person or online. This means it is your responsibility to investigate a listing or a Host Service to determine whether it is suitable for you. For example, Host Services may carry risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those Host Services.

Terms Applicable to Hosts and Travelers

Accommodation Reservation

An Accommodation Reservation is a limited license to enter, occupy, and use the property. The Host retains the right to re-enter the property during your stay, to the extent: (i) it is reasonably necessary, (ii) permitted by your contract with the Host, and (iii) consistent with applicable law. If you stay past checkout, the Host has the right to make you leave in a manner consistent with applicable law, including by imposing reasonable overstay penalties. You may not exceed the maximum number of allowed guests.

Cancellation

At TravelBaby, we are committed to ensuring that the cancellation policies established by each property listed on our platform are fully respected and are processed strictly in accordance with the cancellation policies established in this document. However, in the event of a refund, a deduction of 4% of the total payment will be applied. This deduction corresponds to the transactional costs charged by the payment processing platform as TravelBaby is not responsible for any fees deducted by third-party payment processors. Please note that neither the Host nor TravelBaby retains any portion of this fee; it is exclusively charged by the payment gateway provider.

In general, if a Traveler cancels a Reservation, the amount refunded is determined by the Host’s cancellation policy that applies to that Reservation or Host Services and that it finds in the cancellation details on the listing page, and during the booking process.

If something outside your control forces you to cancel a Reservation, you may be eligible for a partial or full refund, as Hosts sole discretion.

Reasignment of Accomodation and Host Payment Exeptions

In limited circumstances where a Traveler raises a legitimate concern related to the accommodation—such as excessive noise levels, environmental disturbances, or other specific issues materially impacting the quality of the stay—the TravelBaby reserves the right, at its sole discretion, to reassign the Traveler to an alternative accommodation of comparable value. In such cases, and provided that TravelBaby determines that the concern is valid and not caused by the Traveler, the Host of the original accommodation will not be entitled to receive any payment for the affected nights.

TravelBaby’s decision regarding reassignment and withholding of payment shall be final and binding. Hosts acknowledge and accept this policy as a condition of listing accommodations on the Platform.

To request a reassignment of accommodations, the Traveler must notify TravelBaby within the first 24 hours following check-in by submitting a formal complaint through TravelBaby’s designated support channel. The complaint must clearly describe the specific issue(s) affecting the stay (e.g., excessive noise, unclean conditions, safety concerns), and where possible, include supporting evidence such as photos, videos, or audio recordings.

Upon receiving the request, TravelBaby will conduct a prompt review, but no later than 24 hours after receipt of the formal complaint, which may include direct communication with both the Traveler and the Host, and a reasonable opportunity for the Host to respond. If TravelBaby determines that the reported issue materially impacts the quality of the stay and is not attributable to the Traveler, TravelBaby will arrange alternative accommodations of comparable value, subject to availability.

Once the reassignment is confirmed, the Traveler must vacate the original accommodation within the timeframe communicated by TravelBaby. If reassignment is approved, the Host of the original accommodation will not receive payment for the affected nights, as further described in the “Reassignment of Accommodations and Host Payment Exceptions” section. For clarity the Host will only receive payment for the nights the Traveler acually stayed in the accomodation prior to the reasignment.

Booking Modifications

When applicable, travelers and hosts are accountable for any changes to bookings they authorize through the Site or request TravelBaby customer service to execute on their behalf (“Booking Modifications”). They also agree to settle any extra charges, fees, or taxes related to such Booking Modifications.

Content, Layout and Copy

All content and copy edits submitted by hosts are subject to review and approval by us in our sole discretion. We reserve the right to refuse to publish any content that we determine in our sole discretion does not meet these Terms or is otherwise unacceptable to us.

However, we assume no duty to review content and we shall not have any liability for any loss or damage resulting from the design or positioning of the copy, properties, content and/or photographs or any change made to any content, photograph or copy submitted by any member.

We reserve the right to edit content submitted to the Site in a non-substantive manner solely to ensure that the content complies with our content guidelines or formatting requirements. Users are responsible for reviewing and ensuring that any content displayed on the Site appears as the user intended.

Payment Method Requirements

Users’ bank or credit card companies may impose certain fees or charges, including, but not limited to, foreign transaction fees, related to any rental of a property. It is the user’s obligation to review any agreement with its bank or credit card company concerning any such fees.

Resolving Complaints and Damage Claims

If a Host provides valid evidence that you, your guests, or your pets have:

Caused damage to the complaining host’s or the accommodation owner’s (where the accommodation owner is not also the host) real or personal property, or property for which the complaining member is responsible or has an economic interest in; or

Resulted in loss of booking income for bookings made via the Site or other consequential damages directly resulting from the damage described in (i) above; or

Otherwise caused the complaining member to incur cleaning costs exceeding the member’s cleaning fee (each of (i), (ii), and (iii) referred to as a “Damage Claim”),

The complaining member can notify TravelBaby and/or seek compensation through the Resolution Center. You will receive notice of the Damage Claim and have an opportunity to respond. If you agree to pay, or if the Damage Claim is escalated to TravelBaby and TravelBaby determines, in its sole discretion, that the Damage Claim is valid and that you are responsible, TravelBaby may collect the amount of the Damage Claim from you through the payment method you used to make the Reservation. You agree that TravelBaby may seek recovery from you under any insurance policies you hold, and TravelBaby may also pursue any available remedies under applicable law, including referring the matter to a collections agency, and/or pursuing available legal actions or claims against you. You agree to cooperate in good faith, provide any information TravelBaby requests, execute documents, and take reasonable further action related to Damage Claims, member complaints, insurance claims, or other claims arising from your provision or use of host services.

Additional Provisions

Limitation of Liability

IN NO EVENT WILL TRAVELBABY, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, CONSULTANTS, AGENTS AND/OR EMPLOYEES (COLLECTIVELY, THE “TRAVELBABY GROUP”), OR ANY THIRD-PARTY PROVIDER OF A SERVICE OR TOOL OFFERED ON ANY SITE OF A MEMBER OF THE TRAVELBABY GROUP (EACH A “THIRD-PARTY PROVIDER”), BE LIABLE FOR ANY LOST PROFITS OR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES ARISING OUT OF, BASED ON, OR RESULTING FROM (A) OUR SITE, (B) THESE TERMS, (C) ANY BREACH OF THESE TERMS BY YOU OR A THIRD PARTY, (D) USE OF THE SITE, TOOLS OR SERVICES WE PROVIDE, OR ANY THIRD PARTY PROVIDER PROVIDES, RELATED TO THE BUSINESS WE OPERATE ON THE SITE, BY YOU OR ANY THIRD PARTY (E) ANY USER-CONTRIBUTED CONTENT, (F) INTERACTION BETWEEN OUR SITE AND ANY THIRD PARTY SITE, INCLUDING WITHOUT LIMITATION A SOCIAL MEDIA SITE, FACILITATED BY A TOOL OR SERVICE ON OUR SITE AND/OR (G) ANY ACTUAL OR ATTEMPTED COMMUNICATION OR TRANSACTION, INCLUDING WITHOUT LIMITATION, ANY PAYMENT TRANSACTION (EVEN IF WE OR ANY THIRD PARTY PROVIDER RECEIVES A FEE IN CONNECTION THEREWITH) BETWEEN USERS, IN EACH CASE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE LIMITATIONS AND EXCLUSIONS APPLY WITHOUT REGARD TO WHETHER THE DAMAGES ARISE FROM (1) BREACH OF CONTRACT, (2) BREACH OF WARRANTY, (3) STRICT LIABILITY, (4) TORT, (5) NEGLIGENCE, OR (6) ANY OTHER CAUSE OF ACTION, TO THE MAXIMUM EXTENT SUCH EXCLUSION AND LIMITATIONS ARE NOT PROHIBITED BY APPLICABLE LAW.

IN ALL EVENTS, OUR LIABILITY, AND THE LIABILITY OF ANY MEMBER OF THE TRAVELBABY GROUP, TO YOU OR ANY THIRD PARTY IN ANY CIRCUMSTANCE ARISING OUT OF OR IN CONNECTION WITH THE SITE IS LIMITED TO THE TOTAL AMOUNT OF FEES YOU PAY TO US IN CONNECTION WITH ANY TRANSACTION FROM WHICH A DISPUTE ARISES.

THE SITE, INCLUDING ALL CONTENT, SOFTWARE, FUNCTIONS, MATERIALS AND INFORMATION MADE AVAILABLE ON OR ACCESSED THROUGH THE SITE, IS PROVIDED “AS IS.“ TO THE FULLEST EXTENT PERMISSIBLE BY LAW, WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER FOR THE CONTENT ON THE SITE OR THE MATERIALS, INFORMATION AND FUNCTIONS MADE ACCESSIBLE BY THE SOFTWARE USED ON OR ACCESSED THROUGH THE SITE, FOR ANY PRODUCTS OR SERVICES OR HYPERTEXT LINKS TO THIRD PARTIES OR FOR ANY BREACH OF SECURITY ASSOCIATED WITH THE TRANSMISSION OF SENSITIVE INFORMATION THROUGH THE SITE OR ANY LINKED SITE, EVEN IF WE BECOME AWARE OF ANY SUCH BREACHES. WE HAVE NO CONTROL OVER AND DO NOT GUARANTEE (OTHER THAN PURSUANT TO ANY GUARANTEE THAT MAY BE OFFERED ON THE SITE) THE SAFETY OF ANY TRANSACTION, RENTAL LISTING OR THE TRUTH OR ACCURACY OF ANY LISTING OR OTHER CONTENT PROVIDED ON THE SITE.

YOU FURTHER ACKNOWLEDGE THAT BY DISPLAYING INFORMATION OR LISTING LISTINGS IN PARTICULAR DESTINATIONS, WE DO NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH DESTINATIONS IS WITHOUT RISK AND ARE NOT LIABLE FOR DAMAGES WITH RESPECT TO TRAVEL TO ANY DESTINATION.

Release; Indemnification

IN THE EVENT THAT YOU HAVE A DISPUTE WITH ONE OR MORE OTHER USERS OF THE SITE (INCLUDING, WITHOUT LIMITATION, ANY DISPUTE BETWEEN USERS REGARDING ANY TRANSACTION OR USER-CONTRIBUTED CONTENT) OR ANY THIRD PARTY PROVIDER OR ANY THIRD PARTY WEBSITE THAT MAY BE LINKED TO OR FROM OR OTHERWISE INTERACT WITH THE SITE, INCLUDING WITHOUT LIMITATION ANY SOCIAL MEDIA SITE, YOU HEREBY AGREE TO RELEASE, REMISE AND FOREVER DISCHARGE EACH MEMBER OF THE TRAVELBABY GROUP, EACH OF THEIR RESPECTIVE AGENTS, DIRECTORS, OFFICERS, EMPLOYEES, AND ALL OTHER RELATED PERSONS OR ENTITIES FROM ANY AND ALL MANNER OF RIGHTS, CLAIMS, COMPLAINTS, DEMANDS, CAUSES OF ACTION, PROCEEDINGS, LIABILITIES, OBLIGATIONS, LEGAL FEES, COSTS, AND DISBURSEMENTS OF ANY NATURE WHATSOEVER, WHETHER KNOWN OR UNKNOWN, WHICH NOW OR HEREAFTER ARISE FROM, RELATE TO, OR ARE CONNECTED WITH SUCH DISPUTE AND/OR YOUR USE OF THE SITE.

YOU HEREBY AGREE TO INDEMNIFY, DEFEND AND HOLD EACH MEMBER OF THE TRAVELBABY GROUP (COLLECTIVELY, THE “INDEMNIFIED PARTIES“) HARMLESS FROM AND AGAINST ANY AND ALL LIABILITY AND COSTS INCURRED BY THE INDEMNIFIED PARTIES IN CONNECTION WITH ANY CLAIM ARISING OUT OF YOUR USE OF THE SITE OR OTHERWISE RELATING TO THE BUSINESS WE CONDUCT ON THE SITE (INCLUDING, WITHOUT LIMITATION, ANY POTENTIAL OR ACTUAL COMMUNICATION, TRANSACTION OR DISPUTE BETWEEN YOU AND ANY OTHER USER OR THIRD PARTY), ANY CONTENT POSTED BY YOU OR ON YOUR BEHALF OR POSTED BY OTHER USERS OF YOUR ACCOUNT TO THE SITE, ANY USE OF ANY TOOL OR SERVICE PROVIDED BY A THIRD PARTY PROVIDER, ANY USE OF A TOOL OR SERVICE OFFERED BY US THAT INTERACTS WITH A THIRD PARTY WEBSITE, INCLUDING WITHTOUT LIMITATION ANY SOCIAL MEDIA SITE OR ANY BREACH BY YOU OF THESE TERMS OR THE REPRESENTATIONS, WARRANTIES AND COVENANTS MADE BY YOU HEREIN, INCLUDING WITHOUT LIMITATION, ATTORNEYS’ FEES AND COSTS. YOU SHALL COOPERATE AS FULLY AS REASONABLY REQUIRED IN THE DEFENSE OF ANY CLAIM.

WE RESERVE THE RIGHT, AT OUR OWN EXPENSE, TO ASSUME THE EXCLUSIVE DEFENSE AND CONTROL OF ANY MATTER OTHERWISE SUBJECT TO INDEMNIFICATION BY YOU AND YOU SHALL NOT IN ANY EVENT SETTLE ANY MATTER WITHOUT OUR WRITTEN CONSENT.

Taxes

Tax regulations may require that we collect and/or report Tax information about you, or withhold Taxes from payouts to you, or both. If you fail to provide us with documentation that we determine to be sufficient to support any such obligation to withhold Taxes from payouts to you, we may withhold payouts up to the amount as required by law, until sufficient documentation is provided. You agree that TravelBaby may issue on your behalf invoices or similar documentation for VAT, GST, consumption or other Taxes for your Host Services to facilitate accurate tax reporting.

Disputes; Arbitration

PLEASE READ THE FOLLOWING PARAGRAPHS CAREFULLY BECAUSE THEY PROVIDE THAT YOU AND TRAVELBABY AGREE TO RESOLVE ALL DISPUTES BETWEEN US THROUGH BINDING INDIVIDUAL ARBITRATION.

We are committed to traveler satisfaction and to resolving consumer disputes in a timely and efficient manner. We have a two-step dispute resolution process that includes: (1) investigation and negotiation of your claim with our Traveler Support team; and, if necessary, (2) binding arbitration administered by the Centre for Arbitration and Conciliation of the Bogotá Chamber of Commerce.

Any dispute arising out of or in connection with these Terms, including any matter relating to its existence, validity or termination, shall be submitted to and finally settled by means of international arbitration, administered by the Center for Arbitration and Conciliation of the Bogotá Chamber of Commerce, under the Arbitration Rules of the United Nations Commission on International Trade Law, which are deemed to be incorporated into this clause.

The Center for Arbitration and Conciliation of the Bogotá Chamber of Commerce shall be the appointing authority of the Tribunal. The seat or place of arbitration shall be Bogotá. The language of the arbitration shall be English. The applicable law shall be Colombian Law.

Termination, Suspension, and other measures

The agreement between you and TravelBaby reflected by these Terms is effective when you access the Travel Baby Platform and remains in effect until either you or we terminate the agreement in accordance with these Terms.

You may terminate this agreement at any time by sending us . TravelBaby may terminate this agreement for any reason by giving you 30 days’ notice via email or using any other contact information you have provided. TravelBaby may also terminate this agreement immediately and without notice and stop providing access to the Site if you breach these Terms, you violate our , or , you violate applicable laws, or we reasonably believe termination is necessary to protect TravelBaby.

If you violate these Terms, policies, laws, regulations, or third-party rights, or TravelBaby believes it is reasonably necessary to protect TravelBaby, its Users, or third parties; TravelBaby may, with or without prior notice:

● suspend or limit your access to or use of the Travel Baby Platform

● suspend or remove Listings, Reviews, or other Content;

● cancel pending or confirmed bookings; or

For minor violations or by Travel Baby determination in its sole discretion, you will be given notice of any intended measure by Travel Baby and an opportunity to resolve the issue. You may appeal actions taken by us under this Section by contacting customer service. If a Reservation is cancelled under this Section, the amount paid to the Host will be reduced by the amount we refund or otherwise provide to the Guest, and by any other costs we incur as a result of the cancellation.

TravelBaby may take any action it determines is reasonably necessary to comply with applicable law, or the order or request of a court, law enforcement, or other administrative agency or governmental body, including the measures described above.

Miscellaneous

Entire Agreement

Except as they may be supplemented by additional terms, conditions, policies, guidelines, standards, and in-product disclosures, these Terms (including those items incorporated by reference) constitute the entire agreement between TravelBaby and you pertaining to your access to or use of the Site and supersede any and all prior oral or written understandings or agreements between TravelBaby and you. These Terms do not and are not intended to confer any rights or remedies upon anyone other than you and TravelBaby. If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck and will not affect the validity and enforceability of the remaining provisions. Where the word “will” is used in these Terms it connotes an obligation with the same meaning as “shall.”

Personal Data Protection

Travel Baby complies with Colombia’s Law 1581 of 2012 and its regulatory norms regarding the protection of personal data. By using our services, you agree to our Privacy Policy, which outlines how we collect, use, and protect your personal information.

No Waiver

TravelBaby’s failure to enforce any right or provision in these Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise permitted under law.

Assignment

You may not assign, transfer, or delegate this agreement or your rights and obligations hereunder without TravelBaby’s prior written consent. TravelBaby may without restriction assign, transfer or delegate this agreement and any rights and obligations hereunder, at its sole discretion, with 30 days’ prior notice.

Notices

Unless specified otherwise, any notices or other communications to Users permitted or required under this agreement, will be provided electronically and given by Travelbaby via email, Site notification, messaging service (including SMS), or any other contact method we enable, and you provide.

Third-Party Websites

The Site may contain links to third-party websites, applications, services, or resources (“Third-Party Services”) that are subject to different terms and privacy practices. TravelBaby is not responsible or liable for any aspect of such Third-Party Services and links to such Third-Party Services are not an endorsement.

Force Majeure

Travelbaby shall not be liable for any delay or failure to perform resulting from abnormal or unforeseeable circumstances outside its reasonable control, the consequences of which would have been unavoidable despite all efforts to the contrary, including, but not limited to, acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labor or materials.

Modification

TravelBaby may modify these Terms at any time. When we make material changes to these Terms, we will post the revised Terms on the Site and update the “Last Updated” date at the top of these Terms. We will also provide you with notice of any material changes by email, notifications through the Site, messaging service, or any other contact method made available by us and selected by you at least 30 days before the date they become effective. If you disagree with the revised Terms, you may terminate this agreement immediately as provided in these Terms. If you do not terminate your agreement before the date the revised Terms become effective, your continued access to or use of the Site will constitute acceptance of the revised Terms.

Survival

Parts of these Terms that by their nature survive termination, will survive termination of this agreement.
